Section 1: Terms of Use & General Disclaimer

1.1. Acceptance of Terms

By accessing, browsing, or using the GardenwiseConsulting.com website (the "Site") or any associated services, you agree to comply with and be bound by these Terms of Use and all applicable laws and regulations. If you do not agree, you are prohibited from using or accessing this Site.

1.2. General Disclaimer

The information provided on this Site, including blog posts, free guides, and general advice, is for general informational purposes only and is intended to educate and inspire. It does not constitute professional, agricultural, or legal advice.

1.3. Limitation of Liability for Site Content

Gardenwise Design & Consulting makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the information contained on the Site. Any reliance you place on such information is therefore strictly at your own risk. Gardenwise Design & Consulting will not be liable for any loss, damage, or harm arising from your use of the Site or reliance on any general content or advice contained therein.

Section 2: Consulting Services Agreement Summary

2.1. Nature of Consulting Services

Gardenwise Design & Consulting services are strictly advisory and design in nature. Our role is to provide expert guidance, site analysis, custom design plans, and coaching. The client is responsible for the execution of the final plan, including but not limited to purchasing materials, executing construction, and general maintenance.

2.2. Limitation of Liability for Consults

Gardenwise Design & Consulting is not responsible for any damages, losses, or injuries resulting from the client's decision to implement the design or advice provided. Specifically:
 

  • Third-Party Contractors: We are not responsible for the performance, licensing, or insurance of any third-party installer or contractor hired by the client.
     
  • Plant Material/Growth: We cannot guarantee the survival, yield, or health of plants, as success is dependent on factors outside our control (weather, client maintenance, pests, etc.).
     
  • Errors: While every effort is made to ensure accuracy, the client is responsible for confirming all utility line locations and complying with local building codes.

2.3. Intellectual Property (IP) Rights

Upon full payment, the client is granted a non-exclusive, non-transferable license to use the final design plans (e.g., layouts, planting roadmaps) for the sole purpose of constructing and maintaining the garden at the project address. Gardenwise Consulting retains the copyright and all intellectual property rights to the design documents, drawings, and custom content, allowing us to use them for portfolio, marketing, and educational purposes.

Section 3: Operational Policies & Client Expectations

3.1. Cancellation and Rescheduling Policy

For all Starter Consults, Seasonal Consults, and Site Analysis Appointments, we require a minimum of 48 hours advance written notice to cancel or reschedule.

 

  • Cancellations made with more than 48 hours notice will receive a full refund or credit toward a rescheduled session.
  • Cancellations made with less than 48 hours notice, or client "no-shows," are non-refundable.

3.2. Payment Terms and Retainers

  • Consults: Full payment is required at the time of booking through our Calendly/Stripe integration to confirm and secure your time slot.
  • Design & Full-Service Packages: A non-refundable retainer (typically 50% of the project fee) is due upon the signing of the formal Consulting Services Agreement to begin work. The final balance is due upon delivery of the final digital design plans.

3.3. Testimonial Policy

Any testimonials, client photos, or success stories featured on our Site or marketing materials are representations of client experiences. We provide no guarantee that you will experience identical or similar results.
